Overview

ThetaJourney ("the App") is operated by Wise Mind Body LLC ("we," "us," or "our"). This Privacy Policy describes what data the App accesses, how it is used, and how it is stored. We designed the App with your privacy as a core principle: your data belongs to you, stays on your device, and is never sold or shared.

Data We Do Not Collect

We do not collect, transmit, or store any personal data on external servers. Specifically, we do not:

• Collect your name, email, phone number, or contact information
• Track your location
• Access your contacts, photos, or files
• Use analytics, advertising, or tracking services
• Require account creation or login
• Send session data, biometric data, or usage patterns to any server

Device Sensors and Biometric Data

ThetaJourney uses device sensors to provide adaptive bio-feedback during sessions. This data is processed in real time on your device and is never stored beyond the active session or transmitted externally.

CoreMotion (Accelerometer and Gyroscope)

The App accesses your iPhone's accelerometer and gyroscope through Apple's CoreMotion framework to detect body stillness and movement during sessions. This motion data is used in real time to adjust audio parameters and is not stored after the session ends.

AirPods Head-Tracking

If you are using AirPods Pro or AirPods Max, the App accesses head-tracking motion data through Apple's CoreMotion headphone motion API. This data indicates head position and movement and is used to enhance the bio-feedback signal during sessions. Head-tracking data is processed in real time and is not stored.

Apple Watch — HealthKit Integration

If you grant permission, the App reads heart rate (HR) and heart rate variability (HRV) data from Apple HealthKit during sessions. This biometric data is used to drive adaptive audio parameters in real time.

The App also writes mindful session records to HealthKit when a session is completed, if you have granted write permission.

HealthKit data access follows Apple's HealthKit guidelines:

• You must explicitly grant permission for the App to read HR and HRV data
• You must explicitly grant permission for the App to write mindful session records
• You can revoke these permissions at any time in the Health app settings
• HealthKit data is never transmitted to external servers
• HealthKit data is never used for advertising or marketing purposes

Data Stored on Your Device

The App stores the following data locally on your device using Apple's UserDefaults storage:

• Session history: Records of your completed sessions including duration, state selected, regulation depth, and rating. Capped at 100 most recent records.
• Preferences: Your selected settings such as default state, sound preferences, and display options
• Streak data: Your current and longest session streaks, milestone achievements
• Subscription status: A local record of your current subscription tier, synced from RevenueCat

This data is stored only on your device and is not accessible to us or any third party. If you delete the App, all of this data is permanently removed.

Third-Party Services

RevenueCat

The App uses RevenueCat for subscription management and in-app purchase processing. RevenueCat is the only external service that the App communicates with. RevenueCat processes:

• Your subscription status (active, expired, trial)
• Your subscription tier (monthly, annual, lifetime)
• Anonymous app user ID (generated by RevenueCat, not linked to your identity)

RevenueCat does not receive your name, email, biometric data, session history, or any other personal information. Payment processing is handled entirely by Apple through the App Store. We never see or handle your payment information.

No Other Third-Party Services

The App does not integrate with any other third-party services, analytics platforms, crash reporting tools, or advertising networks.

Children's Privacy

ThetaJourney is not directed at children under 13. We do not knowingly collect any information from children. Since the App does not collect personal information from any user, there is no mechanism through which children's data could be gathered.

Data Security

All data remains on your device and is protected by your device's built-in security features, including hardware encryption and passcode or biometric protection. Since session and biometric data are never transmitted over the network, there is no risk of interception or server-side breach.

Your Rights

Because the App does not collect or store personal data on external servers, there is no personal data for us to access, modify, or delete on your behalf. You have full control over all App data through your device:

• Delete the App to remove all stored data
• Revoke HealthKit permissions in the Health app at any time
• Manage your subscription through the App Store

Changes to This Policy

We may update this Privacy Policy to reflect changes in the App or applicable law. Any changes will be reflected in the "Last Updated" date above. Continued use of the App after changes constitutes acceptance of the updated policy.

Agreement

By downloading, installing, or using ThetaJourney ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is operated by Wise Mind Body LLC ("we," "us," or "our").

Description of Service

ThetaJourney is a nervous system regulation app that uses real-time binaural beat synthesis with adaptive bio-feedback. The App generates audio frequencies designed to support brainwave entrainment and provides post-session insights based on physiological data from device sensors.

Not Medical Advice

ThetaJourney is a wellness tool, not a medical device. The App does not diagnose, treat, cure, or prevent any disease or medical condition. The biometric data displayed in the App (heart rate, HRV, regulation depth) is for informational and personal wellness purposes only.

If you have epilepsy, a seizure disorder, or any other neurological condition, consult your physician before using binaural beat audio. If you experience discomfort during use, stop immediately.

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider with questions about a medical condition.

Subscriptions and Purchases

The App offers a free tier with access to Calm and Focus states. Additional features are available through auto-renewing subscriptions or a one-time lifetime purchase, processed through the Apple App Store.

• Monthly: $8.99/month, billed monthly
• Annual: $49.99/year, with a 7-day free trial, billed annually
• Lifetime: $99.99, one-time purchase

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refunds are handled by Apple per their App Store refund policies.

Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Use the App while operating a vehicle or heavy machinery
• Redistribute, sublicense, or resell the App or its content
• Use the App in any way that violates applicable law

Intellectual Property

All content, code, audio synthesis algorithms, guided session designs, and visual assets in the App are the property of Wise Mind Body LLC and are protected by copyright and intellectual property laws. Your subscription or purchase grants you a personal, non-transferable, non-exclusive license to use the App.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that it will produce any specific physiological outcome. Individual results vary based on physiology, environment, and consistency of use.

Limitation of Liability

To the maximum extent permitted by law, Wise Mind Body LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to physical discomfort, sleep disruption, or reliance on biometric data displayed in the App.

Termination

We reserve the right to modify, suspend, or discontinue the App at any time. You may stop using the App at any time by deleting it from your device.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Changes will be reflected in the "Last Updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
